Unsafe Driving Methods, Traffic Violations and Line of Defense

Speeding is a habit that has spread like cancer with those who drive. In states like Montana were traffic regulations are far too relaxed, it is the citizens who are expected to observe the necessary safety measures on the road.

The National Highway Traffic Safety Administration conducted a survey in 1997 which brought forth some noteworthy pointers. Most drivers, irrespective of their age, admitted to speeding while driving. Male drivers were 50% more inclined to speed than females. Most drivers seemed to have the, “it’s not me but the other driver who was speeding,” attitude. As motor vehicle crashes are one of the major causes of death in the US, it is important to understand how unsafe driving methods can trigger accidents.

Common Unsafe Driving Methods

Generally, the following unsafe driving methods were reported as factors that endanger the safety of others:

  • Cutting in front of other vehicles on the road;
  • Street racing;
  • Drunken or reckless driving;
  • Showing obscene gestures;
  • Driving into an intersection when the traffic light turns from yellow to red; and
  • When teenagers and young drivers do not wear seat belts.

When any of these unsafe driving methods result in an accident, it means legal trouble. So, it becomes essential to consult a well known legal expert or lawyer in this field.

Laws and Line of Defense Relating to Traffic Violations

Most laws that pertain to traffic violations such as speeding are so complex that you will be better off with a lawyer’s expert guidance than trying to figure it out on your own.

If you plan to deal with traffic violations without legal expertise, here are some suggestions:

  • You are considered innocent until the court proves that you violated a traffic law;
  • In 20 states, the law is that, it is ok to drive slightly over the speed limit, provided the conditions were safe enough to do so; and
  • Study the state’s laws and famous cases before you plead your case.

Experienced lawyers, on the other hand, would prove your defense more effectively as follows:

  • Focus on each element of a law so that it becomes possible to determine an effective and convincing line of defense.
  • Check and do research to establish that there are other legal defenses that exist with regard to the law you are charged with violating.

  • Using pertinent case law and interpretation of relevant statutes is a key skill of personal injury lawyers.

Far too many traffic violations result in accidents; but to prove your case, don’t make unbelievable defense stories like: you really had no idea about the state’s speeding laws or that your child was sick. Prove your line of defense in the right way by consulting with the best known personal injury lawyer in this field.
