In this video, Sol lays out the basic structure of a lawsuit, from the initial filing of the facts and allegations to the subsequent settlement or trial. He covers the discovery process and how information is obtained by both sides in a case through subpoenas and depositions. What types of documents will the opposition want from you? How will the facts of the case be determined? What about facts in dispute?
Sol also addresses mediation and how that part of a lawsuit is done. What is the goal of mediation? Who is in charge for this procedure? How long does mediation last? With only about 5% of cases going all the way to trial, the mediation process is an important part of any lawsuit.

This important public television report exposes the disconnect between how insurance is sold and how claims are actually paid. Real homeowners tell their stories – sometimes tragic examples of the techniques some insurance companies are using to delay claims. By simply delaying, those in need are pressured to settle for amounts far beneath what they expect and deserve.
Customers expect fair resolutions, but unfortunately, lowering settlements has become another way for the insurance industry to increase profits. “It’s like calling 9-1-1 and getting hung up on,” says one victim.
Well worth the time to view, this piece has the information you need before you find yourself calling an agent, either for a policy change or a claim. Find out why an attorney may be your best hope for getting what you deserve. Click here to view it on PBS.

The families of three Billings teenagers injured in an accident have filed a District Court lawsuit alleging the accident happened during a drag race. The lawsuit seeks unspecified damages for alleged negligence by Chad Teal for an incident on May 23 near the intersection of Overland Avenue and South 24th Street West. The lawsuit also names his mother, Nadine Teal, as a defendant. "The defendant Chad Teal's willful and reckless disregard for the safety of the plaintiffs by drag racing against Matt Evenson caused injuries to the plaintiffs," the lawsuit states. |

The lawsuit, filed Oct. 9 by Billings attorney Solomon Neuhardt, seeks damages for medical expenses, lost earnings, "severe pain and suffering of mind and body, impaired earning capacity, loss of normal course of living, loss of consortium, and loss of society." Neuhardt said claims by his clients against Evenson, who was cited for reckless driving as a result of the incident, have been settled without litigation. Teal's insurance company has denied any fault in the accident, which led to the lawsuit, Neuhardt said. |

Sometimes, emotion and the need for revenge motivate clients to push for a lawsuit that will ultimately fail. This can occur in medical malpractice or any injury case. Mr. Neuhardt, referencing his extensive experience as an injury attorney in Billings, Montana, clears the air and gives the basics that must be in play for a case to proceed.
Injustice and wrongdoing abound. Yet not all cases have enough merit to warrant a lawsuit. One of the goals of an initial consultation is an estimate of whether or not a lawsuit should even continue. In this video, Mr. Neuhardt discusses some common factors that lead to a case being rejected by his firm.
The key elements needed are: establishing fault, real damages, and the significance of the matter. Without these, a case cannot move forward. Sol also discusses clients who lie or make false accusations and those who are unable or unwilling to participate in the process.

Traumatic Brain Injury (TBI) is often unrecognized by patients because they are unfamiliar with the symptoms. Loss of memory and concentration, or difficulty sleeping is sometimes blamed on another cause or simply ignored. As a Montana accident attorney, Sol represents victims of TBI and relates how a referral for evaluation can establish the condition.
In this video, Mr. Neuhardt explains some of the causes and consequences of TBI as well as the tactics an insurance company may use to avoid paying claims for the injury.
