Dog Bite Injuries
Even the tamest dog can sometimes act violently when it feels its territory is threatened. In fact, many owners rely on this aggressive tendency to protect their property. But an animal that is improperly restrained or confined can represent a danger to the public. Dog owners who allow their pets to roam or otherwise act irresponsibly will be found at fault.
Most animal bite injuries result in claims against an individual or a homeowner’s policy. Either can result in a lawsuit.
Many animal attacks and dog bites go unreported because the person injured is worried about the pet being destroyed. In Montana, animals are not euthanized as a rule. They may be held under observation to see if they develop rabies, but unless the dog has a history of dangerous conduct it will be returned to the owner. Documenting your incident is important. It gives the owner fair warning so they can take action to secure the animal in the future and it also records an incident of aggressive behavior.
Do I have a case?
In some circumstances a dog bite or other animal attack is excusable. If you are trespassing or taunting an animal there may be justification. However, in most instances of dog attack or bite, the owner of the animal is fully or partially at fault.

Some guidelines for those attacked are:
- Remove yourself from immediate danger and call for assistance – 9-1-1 or other help.
- Seek medical treatment. Document the injury with photographs if possible.
Tell the treating physician the breed of the dog (or type of animal) – this will assist them in evaluating the damage. - Inform the police if you haven’t already. They will activate animal control and make a report about the incident. They will also attempt to find the animal’s owner and determine rabies immunization status.
- Identify the dog/animal that bit you to officers when requested. Breed, size, sex, whether it had a collar (and collar color) and any distinguishing marks are all important.
- Write down what happened as soon as you are able. Memories fade and it is important to capture any details you remember as soon as you can. Add information later as it occurs to you.
