Nursing Home Abuse
The excuses are many: overworked or underpaid staff, expensive care and the worst – an uncooperative or “combative” senior. How is a loved one to know where the truth fits in when they are told repeatedly that their mother “fell out of bed” or “fights with staff?” It may take a careful examination of records, an expert opinion and testimony to properly ferret out wrongdoing.
What about a death? This is especially hard. When someone only has a precious few years left, to deny them the chance to see a grandchild graduate or a great-grandchild brought into the world… the matter shouldn’t be ignored.
If you suspect your loved one is being neglected or abused while in a nursing home or facility, it is your duty to take action. A settlement for negligence will not only help with their case, but hopefully lead to better care across the board. It may be only one staff member who needs to be discharged.
Hiring an attorney
If you feel your concerns are not being addressed, or there has been clear evidence that neglect has occurred, it is time to discuss the matter with an attorney knowledgeable in elderly abuse cases. They will be able to listen to the facts and advise you on how best to proceed. Documentation is critical and the more you delay starting an action, the harder it may be to get the necessary evidence.
It is a fact of life that legal action may be necessary to remedy ongoing flaws in needed care. On the positive side, our elderly citizens have the same legal rights as others. They may be ignored or neglected in a nursing home, but they certainly will not be in court. Contact our personal injury attorney for assistance.
